Terms & Conditions for RK Constructions Construction Services

Terms governing use of our website and the framework for our construction services in Mysuru and Karnataka—including quotations, project dependencies, cancellations, and limitations of liability.

Effective date: [DD Month YYYY]

Use of this website does not create a binding construction contract. A separate written agreement and quotation is required before project work begins.

1. Acceptance of terms

By accessing or using the RK Constructions website (“Website”), you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the Website.

Information on the Website—including project photos, budget tools, and service descriptions—is for general information and enquiry purposes. It does not constitute a binding offer, contract, or guarantee of availability, pricing, or timelines.

A construction project with us begins only after mutual execution of a written quotation, work order, or construction agreement specifying scope, price, payment schedule, and timelines.

2. Nature of our services

RK Constructions provides construction-related services including, where agreed in writing, residential and commercial contracting, structural execution, renovation, design coordination, and project management in Karnataka, India.

Our services are project-based and delivered at the client’s site or as otherwise specified in your contract. We do not sell physical products, building materials retail, or real estate through this Website.

  • We are not a real estate broker, property dealer, or developer selling land, flats, or plots through this Website.
  • We do not transfer property ownership, facilitate property registration, or act as a legal adviser on title or encumbrances.
  • Third-party professionals (architects, structural engineers, government authorities, utility providers) may be involved as required by your project and applicable law.

3. Quotations, estimates, and pricing transparency

Construction costs vary based on site conditions, design, materials, labour, approvals, and market factors. Any figures shown on the Website—including the Cost Calculator planning tool—are indicative estimates for planning purposes only.

  • Online estimates are not quotations and are not binding on either party.
  • A formal quotation or bill of quantities (BOQ) will be shared after site review, drawings, and scope discussion.
  • Final project cost may differ from initial estimates due to design changes, material selection, regulatory requirements, or unforeseen site conditions.
  • All binding prices, payment milestones, and taxes (including GST, where applicable) will be stated in your signed agreement.
  • This Website does not process online payments. Fees are collected offline per your contract (e.g. bank transfer) after written agreement.

4. Regulatory approvals and third-party dependencies

Construction projects in Karnataka often depend on approvals and actions beyond our sole control, including:

  • Municipal or local body permissions (e.g. BBMP, Gram Panchayat, or relevant authority).
  • RERA or other regulatory compliance where applicable to the project type.
  • Utility connections (water, electricity, sewage) and neighbour or society consents.
  • Availability and performance of subcontractors, suppliers, and specialised consultants.
  • Client-provided documents, site handover, and timely decisions on design and materials.

Responsibility allocation

Unless expressly agreed in writing, obtaining certain statutory approvals or NOCs may be the client’s responsibility or shared as defined in your contract. We will coordinate reasonably where our scope includes liaison support.

5. Timelines, delays, and force majeure

Project schedules communicated on the Website or during preliminary discussions are indicative only. Committed timelines appear in your signed contract.

Delays may occur due to factors including but not limited to:

  • Weather, monsoon, flooding, or natural events.
  • Labour availability, strikes, or local restrictions.
  • Material price fluctuations, shortages, or supply-chain disruption.
  • Pending approvals, inspections, or authority inspections.
  • Client-requested variations, payment delays, or site access issues.
  • Force majeure events including epidemics, government orders, or civil disturbances.

No website guarantee of dates

Unless expressly stated in a signed contract, we do not guarantee completion dates or milestone dates based solely on Website content or verbal discussions.

6. Client obligations

To enable safe and efficient project delivery, clients are expected to:

  • Provide accurate information during enquiry and contract stages.
  • Grant reasonable site access, utilities, and storage where required.
  • Make payments per the agreed schedule in the signed contract.
  • Approve designs, materials, and variations within agreed timeframes.
  • Obtain or facilitate approvals that are contractually assigned to the client.

7. Disclaimer

Website content—including images of completed projects, testimonials, and technical descriptions—is provided in good faith for illustration. Past projects do not guarantee identical outcomes for your site.

We do not warrant that Website information is complete, current, or suitable for every location without site-specific assessment.

Structural, soil, and legal suitability of a site must be evaluated through appropriate surveys and professional review before construction commitments.

8. Limitation of liability

To the fullest extent permitted by Indian law, we shall not be liable for indirect, incidental, special, or consequential losses arising from use of the Website or reliance on non-contractual information.

Liability for construction services performed under a signed contract shall be governed by that contract and applicable law. Website use alone does not create construction liability beyond what applicable law requires.

Nothing in these Terms excludes liability that cannot be excluded under the Consumer Protection Act, 2019, or other mandatory Indian law.

9. Refund and cancellation policy (services)

Because we provide construction services—not retail products—refunds and cancellations are governed by your signed quotation or construction agreement. The following general principles apply where not superseded by your contract:

  • Enquiry submission via the Website is free and may be withdrawn at any time before contract execution.
  • Advance payments, mobilisation amounts, or booking fees are non-refundable unless your written agreement states otherwise.
  • If you cancel after work has commenced, you may be liable for work completed, materials ordered, site costs, and reasonable demobilisation charges as per your contract.
  • If we cancel due to non-payment, site inaccessibility, or material breach by the client, refund of any advance will be handled per contract terms and applicable law.
  • Disputes regarding refunds will be addressed through good-faith discussion, our grievance process, and consumer remedies available under Indian law.

No product returns

This policy does not involve product returns or e-commerce refunds. Custom construction work, labour, and procured materials are evaluated on a project basis as defined in your agreement.

10. No shipping or physical goods delivery

RK Constructions does not sell or ship physical goods through this Website. We do not operate an online store, courier service, or product delivery model.

Materials for your project are procured and delivered to the construction site as part of project execution under your contract, not as retail e-commerce shipments to consumers via this Website.

11. Intellectual property

All Website content—including text, logos, photographs, designs, layouts, and graphics—is owned by RK Constructions or its licensors and protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or exploit Website content for commercial purposes without our prior written consent. Project-specific drawings and documents are governed by your construction agreement.
